Terms & Conditions
This Agreement sets forth the Terms and Conditions for services provided by Helen Driver, coach and founder of The Rising Space (hereinafter “the Practitioner”) to you, the client (hereinafter “the Client”). Its purpose is to outline the scope of services and mutual expectations in a clear and professional manner. By engaging the Practitioner’s services, the Client acknowledges and agrees to the following terms.
1. Payment and Refund Policy
All coaching sessions and packages require full payment in advance to secure the booking unless otherwise agreed or if you have chosen a payment plan. All payments are non-refundable once made.
6 Week Coaching Journey:
Due to the personalised nature of this programme, refunds are not available. The Practitioner is committed to providing a valuable and transformative experience and will make reasonable adjustments where needed. If issues arise, both parties will work together to find an appropriate solution.
2. Cancellation and Rescheduling Policy
Client Cancellations
Coaching sessions can be cancelled or rescheduled with at least 48 hours’ notice. Where sufficient notice is given, the session may be credited toward a future date.
Late Cancellations and No-Shows
Sessions cancelled with less than 48 hours’ notice, or unattended without notice, will be charged in full. No refunds will be issued.
Practitioner Cancellations
If the Practitioner must cancel due to illness, emergency, or unforeseen circumstances, the Client will be offered a rescheduled appointment or full refund.
3. Cancellation and Refund Policy for Classes and Events
Client Cancellations
Late cancellations or non-attendance result in loss of fees.
Ticket Policy
All ticket purchases are final and cannot be refunded or transferred to another event. Tickets may be gifted to another person. Check the terms and conditions of your event.
Practitioner Cancellations
If the Practitioner cancels a class or event, the Client may choose a full refund or transfer to a future date.
4. Health and Safety Disclaimer
Participation in any event, session, or practice, including but not limited to coaching, ceremonial cacao, meditation, breathwork, sound therapy, somatic work, EFT, or creative workshops, is at the Client’s own risk.
The Client is responsible for consulting a healthcare provider before attending if they have any pre-existing conditions or concerns, including:
Heart conditions
Epilepsy or seizure history
High or low blood pressure with a history of fainting
Pregnancy (not recommended in the first trimester)
Bipolar disorder, schizophrenia, psychosis, or personality disorders
Untreated or severe PTSD
Respiratory conditions or recent major surgery
Stroke history, glaucoma, or detached retina
Asthma, where the Client must bring their inhaler
Allergies or sensitivities to cacao, food, incense, herbs, or aromatic substances
Event Environment
Events may take place at the Practitioner’s private address, hired venues, or public spaces. The Client acknowledges:
Cats may be present at the Practitioner’s home
Incense, sacred wood, herbs, or aromatic substances may be used
It is the Client’s responsibility to ensure they can safely participate
Physical Touch
Some practices may involve optional, supportive physical touch. Consent is always sought and the Client may decline at any time. The Practitioner is not liable for reactions to consensual touch during sessions.
5. Ceremonial Cacao Contraindications
Ceremonial Cacao contains active compounds, including theobromine, that affect the cardiovascular and nervous systems. By participating in cacao ceremonies or consuming cacao provided by the Practitioner, the Client agrees to the following.
Medical Considerations
The Client must consult a healthcare provider before participating if they have:
Heart conditions or cardiovascular concerns
High blood pressure
Low blood pressure with a history of fainting
Epilepsy or seizure history
Anxiety disorders sensitive to stimulants
Schizophrenia, bipolar disorder, psychosis, or untreated severe mental health conditions
Pregnancy, especially first trimester
Gastrointestinal issues affected by stimulants
Sensitivities or allergies to cacao
Recent major surgery
Any condition where cacao may interfere with medication or symptoms
Medication Interactions
Cacao may interact with:
MAOI antidepressants
SSRIs or SNRIs
Stimulant medications, including some prescribed for ADHD
Blood pressure medication
Medications affecting the heart or nervous system
The Client is responsible for checking with their healthcare provider.
Dosage Responsibility
The Practitioner may offer full ceremonial doses, low doses, or microdoses
The Client may request a reduced dose or decline cacao
The Practitioner is not liable for adverse effects resulting from undisclosed health information
Pregnancy and Breastfeeding
Cacao is not recommended in the first trimester
Clients who are pregnant or breastfeeding must seek medical guidance before participating
By consuming ceremonial cacao, the Client confirms they understand the effects, have disclosed relevant information, and take full responsibility for their wellbeing.
6. Commitment to Progress
The Practitioner is committed to supporting the Client throughout their journey. The Client agrees to raise questions or concerns promptly so support can be adapted where needed. The Practitioner is there to offer guidance and support, but ultimately the Client is responsible for their own progress.
7. Confidentiality and Data Protection
The Practitioner maintains confidentiality for all Client information, communications, and records, except where legally required. All data is handled in compliance with UK and EU GDPR regulations.
Data Storage
Session notes and records are securely stored for the legally required duration via Zoom notes (online sessions) and for coaching journeys, on Google Drive, which is shared with the client. The Client has the right to request access to the session notes.
Digital Communication
Email, messaging apps, and other digital platforms carry inherent risks that the Client accepts when choosing to communicate via these channels.
8. Liability Disclaimer
Results Not Guaranteed: Outcomes depend on the Client’s participation and circumstances.
Not Medical Services: The Practitioner’s services are complementary and not a substitute for medical or psychological treatment.
Limitation of Liability: The Practitioner’s total liability shall not exceed the amount paid for services.
Client Responsibility: The Client is responsible for their own decisions, actions, and wellbeing.
9. Client Responsibilities
The Client agrees to:
Communicate honestly
Engage actively in sessions
Attend punctually
Conduct themselves respectfully
Take personal responsibility for their health, wellbeing, actions and personal growth
Provide feedback when needed
10. Distinction Between Coaching and Therapy
The Practitioner’s services, including Holistic Mindset and Wellbeing Coaching, EFT, somatic guidance, and ceremonial cacao sessions, do not replace therapy, medical treatment, or mental health services. Clients experiencing crisis or requiring clinical intervention should contact emergency services or an appropriate healthcare professional.
11. Informed Consent
By attending sessions or events, the Client confirms they:
Understand the nature of the practices
Participate voluntarily
May pause, decline, or withdraw at any time
Take responsibility for communicating their needs, triggers and limits
12. Late Arrivals
Late arrivals shorten the session time and will not result in a reduced fee.
13. Recording Policy
Sessions are not video recorded by the Practitioner unless agreed in writing. AI note taking is used during all Zoom online sessions to support Client safety and to help the Practitioner maintain accurate, confidential session notes. No audio or video is stored and all data is handled in accordance with GDPR regulations. Clients may not record sessions without express written permission. All written materials, practices, and resources shared remain the intellectual property of the Practitioner.
14. Gift Vouchers and Third Party Purchases
Where applicable:
Vouchers have a fixed expiry date
Vouchers can be topped up if the chosen service or event exceeds the voucher value. Any remaining balance must be paid by the Client at the time of booking
They are non-refundable
They cannot be transferred between services unless agreed by the Practitioner
15. Amendments and Governing Law
Amendments:
The Practitioner may update these Terms and Conditions. Changes will be communicated in writing. Continued use of services constitutes acceptance.
Governing Law:
These Terms are governed by UK law. Disputes are subject to UK courts.
Dispute Resolution:
Both parties agree to attempt informal negotiation or mediation before legal action.
Acceptance
By using the Practitioner’s services, the Client confirms they have read, understood, and agree to these Terms and Conditions voluntarily and legally.
